Terms & Conditions

These Terms & Conditions govern your access to and use of Push Up League, a mobile fitness app operated by 03 Studios. By downloading, accessing, or using Push Up League, you agree to these Terms. If you do not agree, do not use the app.

You must be at least 13 years old to use Push Up League. If you are under the age of legal majority where you live, you may use the app only with permission from a parent or legal guardian, who should review these Terms with you.

Push Up League provides gamified push-up workouts, camera-assisted repetition counting, progress and goal features, training personalization, reminders, league or challenge experiences, and related fitness content. Features may change, and some features may require an account, device permission, or paid subscription.

Push Up League provides general fitness information and motivation only. It is not medical advice, diagnosis, treatment, physical therapy, or a substitute for a qualified healthcare or fitness professional. The app does not assess whether an exercise is safe or suitable for you.

Exercise involves risk of injury. Before starting, consider your health, fitness level, surroundings, and any illness, pregnancy, pain, injury, or medical condition, and consult a qualified professional where appropriate. Use a safe, clear surface, maintain appropriate form, and stop immediately if you experience pain, dizziness, shortness of breath beyond normal exertion, or other concerning symptoms. In an emergency, contact local emergency services.

You remain responsible for deciding whether and how to exercise. To the extent permitted by law, 03 Studios is not responsible for injury or harm caused by unsafe exercise, improper form, unsuitable surroundings, ignored medical advice, or use beyond your personal limits.

The camera feature uses automated on-device pose estimation to count repetitions. Detection can be inaccurate because of lighting, camera position, clothing, movement, visibility, device performance, or technical limitations. Counts, scores, rankings, and form-related feedback are estimates and must not be relied on as professional supervision or proof that an exercise was performed safely or correctly. You are responsible for positioning your device securely.

Certain features may require Sign in with Apple or Google. You are responsible for maintaining the security of your identity-provider account and for activity under your Push Up League account. Provide accurate information, do not impersonate another person, and notify us if you suspect unauthorized access.

Push Up League may offer auto-renewing monthly, yearly, or other subscription plans. The product, billing period, price, trial terms if any, and benefits shown in the Apple purchase sheet at confirmation control your purchase. Payment is charged to your Apple ID account.

Subscriptions renew automatically unless you cancel through your Apple account settings within the period required by Apple before renewal. Cancellation takes effect at the end of the current paid period; deleting the app or your Push Up League account does not cancel an Apple subscription. Refunds, billing disputes, and App Store purchase history are handled by Apple under its applicable terms.

We may change future subscription prices or included features where permitted by law and platform rules. Any required notice or consent will be provided through Apple or the app. You can use Apple's restore-purchase function where available.

Camera and notification access are optional device permissions. You may change them in iOS Settings, but related features may then be unavailable. Reminders are provided for convenience and are not guaranteed to arrive at a particular time.

You agree not to:

• use Push Up League for an unlawful, fraudulent, harmful, or abusive purpose;
• interfere with the app, its infrastructure, security, or other users;
• bypass subscriptions, paywalls, access controls, or technical limits;
• reverse engineer, decompile, scrape, copy, or modify the app except where applicable law expressly permits it;
• use automation, exploits, or false activity to manipulate repetitions, scores, progress, rankings, purchases, or entitlements; or
• violate another person's rights, privacy, or safety.

Push Up League, including its software, game systems, characters, monsters, artwork, design, branding, text, audio, graphics, and other content, is owned by 03 Studios or its licensors and is protected by intellectual property laws. We grant you a personal, limited, non-exclusive, non-transferable, revocable license to use the app for its intended purpose under these Terms. No ownership rights are transferred to you.

Push Up League relies on services from Apple, Google, Supabase, Firebase, Superwall, and other providers. Their services and accounts may be subject to separate terms and privacy policies. 03 Studios is not responsible for third-party services outside its control. Your use of the iOS app is also subject to the applicable Apple Media Services Terms and App Store rules. Apple has no obligation to provide maintenance or support for the app, and Apple and its subsidiaries are third-party beneficiaries of these Terms to the extent applicable law permits.

We may update, test, add, remove, suspend, or discontinue features, content, leagues, challenges, or the app itself. We do not guarantee that Push Up League will always be available, uninterrupted, secure, or compatible with every device or operating-system version. Maintenance, provider outages, and network conditions may affect availability.

To the maximum extent permitted by law, Push Up League is provided "as is" and "as available". We do not guarantee specific fitness, strength, health, habit, ranking, or other results; accurate repetition counts; or error-free operation. Nothing in these Terms excludes warranties or rights that cannot lawfully be excluded, including mandatory consumer rights.

To the maximum extent permitted by law, 03 Studios will not be liable for indirect, incidental, special, consequential, or punitive damages, or for loss of data, profits, goodwill, or other intangible losses arising from Push Up League. Our liability is not limited where limitation is prohibited by law, including for intent, gross negligence, injury to life, body, or health where applicable, or mandatory consumer liability.

You may stop using Push Up League at any time. We may restrict or terminate access if you materially or repeatedly violate these Terms, threaten the service or other users, engage in fraud or abuse, or where required by law. Where reasonable and legally required, we will provide notice and an opportunity to remedy the issue. Sections that by their nature should survive termination remain effective.

Our processing of personal data is described in the Push Up League Privacy Policy.

We may update these Terms to reflect changes in Push Up League, the law, or our services. We will publish the updated Terms with a new effective date and provide additional notice where required. Continued use after the updated Terms take effect means you accept them, except where applicable law requires express consent.

These Terms are governed by Italian law, excluding conflict-of-law rules. If you are a consumer, this choice does not deprive you of mandatory protections under the law of your country of residence, and you may bring a claim before any court available to you under mandatory consumer law. Otherwise, the competent courts of Bolzano, Italy, have jurisdiction.
